EB Motion #13-21 – Accept the BOI’s findings regarding charges filed against Vice President Mark Scarberry and amend the recommended sanctions 

Motion by Michele Clubb, Secretary, on behalf of the Board of Inquiry, and seconded by Dennis Vander Linde, DAL, to accept the BOI’s findings regarding charges filed against Vice President Mark Scarberry and amend the recommended sanctions

Amended Sanctions:  USCA member Mark Scarberry shall not be permitted to seek or hold any leadership position within USCA, including but limited to: President, Vice President, Treasurer, Secretary, Director of Judges, National Breed Warden, Director at Large, Regional Director, any regional position, or member of a committee for three years.

Background: On October 4, 2020, BOI charges were filed by USCA President Vadim Plotsker against USCA Vice President Mark Scarberry for knowingly providing false testimony as a witness to the Board of Inquiry.  Per USCA Bylaws Article XI, Section 3 subsection h, the President or Secretary “shall file” charges against a witness who knowingly provided false testimony to the BOI.

On January 20, 2021 the BOI submitted their recommendation to the USCA Secretary.  The BOI confirmed that Vice President Mark Scarberry lied during the original investigation of the BOI charges filed against him by USCA Secretary Michele Clubb in January 2020.   The BOI also determined that Vice President Mark Scarberry lied again during the investigation of the charges filed by President Vadim Plotsker.  The BOI recommended a one year suspension from USCA per the 2008 General Board meeting minutes, Item #7, in which the General Board unanimously ruled that the discipline for false testimony by a witness to the BOI is “suspension from all USCA privileges for a minimum of one year.”

On March 1, 2021 Mark Scarberry submitted.an appeal regarding the BOI’s recommendation. Per the Bylaws, Article XI, Section 4 subsections a and b,  the appeal was submitted to the Directors at Large.

On March 19, 2021 the Directors at Large advised the USCA Secretary that they unanimously denied the appeal by Mark Scarberry.

After discussions within the Executive Board, it is recommended that the amended sanctions be presented to the Executive Board to vote
