HOT Helpers Selected!

Nathanial Roque, Chair of the USA Helper Committee, announced the results of the
helper selection for the 2008 HOT/Obedience and Youth Championships.

The 2008 HOT Championships are being hosted by the OG Buckeye Club at the historic Akron Rubber Bowl -- the third largest university football stadium in Ohio. The event will be held starting June 19 and runs through Sunday, June 22. For more information about the 2008 HOT/Obedience and Youth Championships, see the event website at

Judge's Inquiry Not Sustained, RE: Carla Griffith
March 17, 2008
On December 7, 2007, USA Member Chris Bettin filed a complaint regarding the conduct of
USA Judge Carla Griffith at a USA trial held on November 18 and 19, 2006. He alleged
the judge was not present at the AD. Additionally, he claimed a Schutzhund 1 dog should
not have been passed because the handler gave the dog a 'Platz' command in order to
regain control of the dog at the transistion from the bark and hold to the helper escape.
Bettin also claimed the out on the courage test was faulty. Mr. Bettin had no direct
knowledge of the AD incident. He was an observer at the SchH1 test.
Director of Judges, Mark Przybylski and committee member, Mark Gardner contacted the
witnesses and participants of the November 2006 trial.
- Regarding the AD, there was no
evidence to support this allegation.
- Regarding the SchH1, the Judge's and Helper's responses were in accordance with each other.
This was a local club trial and the judge exercised her discretion in evaluating the dog.
According to the report,
"This was a local club trial, and some latitude was given to the Schutzhund I dog.
This is in line with tradition in our sport, and at the discretion of The Judge,
but no blatant rule violation occurred."
The Judge's Committee found the complaint to be, "Not Sustained" and that USA Judge Carla Griffith
is allowed to continue her duties in accordance with rules and standards set
by USA and its executive board.

Six USA Helpers — Chris Carr, Jose Lopez, Clark Niemitalo, Lotus Perkins, Shane Garrehy and Jim Laubmeier traveled to Cincinnati for the 2008 WUSV Helper Tryouts on Monday, March 3.
Representatives from the USA WUSV Committee as well as the WUSV were present for the tryouts. Günther Diegel from the WUSV conducted the tryout and selected the following four helpers for the 2008 WUSV World Championships:

SV Breed Surveys and Elbows
February 15, 2008
USA Breed Warden, Tim Burke announced that the SV has mandated that all dogs born
after January 1, 2004 (regardless of country of origin) must have elbows
certified by the SV if they want an SV breed survey. They will not accept OFA elbows.
Tim is meeting with the SV office the first week of March to establish procedures
so the USA office can assist members in obtaining SV elbow certification similar
to the USA “a” stamp program.
We do not have this requirement yet for USA breed surveys. The Breed Advisory Committee
will take this under advisement after the Sieger show to discuss if we want to implement
this rule for USA breed surveys.
WUSV 2008: Championship Update

The countdown is on!
By the time you read this, there will be less than nine months
before the top dog/handler teams from around the world converge on the United States
for the 21st WUSV World Championship. Hosted by the United Schutzhund Clubs of America,
this world-class event will take place Oct. 9-12, 2008, in the Greater Cincinnati,
OH, area.
First, let’s recap the great amount of progress that’s been made so far. USA has
selected a 4,000-seat minor league ballpark in Florence, KY, as the site for the
trial. The dirt portion of the infield will be replaced with grass. Tracking grounds,
about a 10-minute drive from the stadium, will consist of 1,200 acres of grass on
rolling hills.
Our major sponsor, Royal Canin, has been secured, as has our equipment sponsor,
Hallmark K9. The project plan for the event has been further detailed, and a budget
has been finalized and approved by the Executive Board.
On the promotions front, we have an official event logo, and the event web site
(www.wusv2008.org) is live. The web site is an excellent resource for spectators
and competitors alike, and will include extensive details on everything from route
planning and travel information to officials, sponsors, key contacts, results and
team bios. If you’d like a sneak peak into the event location and facilities, check
out the short video located on the home page. Be sure to visit the WUSV 2008 Event
Merchandise shop (www.wusv2008.org/shop.htm ) to order commemorative t-shirts, sweatshirts
and hats decorated with the official event logo—available now.
We are also thrilled to report that we have exceeded our membership fundraising
goal! We hoped to raise $25,000 from 450 donations (which represents about 11% of
the membership) by April 2007. To-date we have raised $33,780 from about 630 individuals.
Thanks to those members for their generous and much-needed support, and let’s keep
those donations coming.
Though we have made great strides, there is still much hard work to be done to ensure
that this is truly an event to remember. The success of this championship depends
on the support and involvement of our membership—are you up to the challenge?

The Breed Advisory Committee has chosen SV judges Herr Wilfried Scheld to judge
the female working class and Herr Klaus Gothe to judge the male working class.

Sieger Show Date Changed!

The date for the 2008 Sieger Show has been changed from April 18 — 20 to April
11 — 13.
Last Thursday, National Breed Warden Tim Burke received an email from the SV office
in Germany, informing him that the SV has scheduled their spring meeting for the
same weekend as our 2008 Sieger show. Therefore, the judges would not be able to
attend our show because they were required to attend the SV meeting.
After a flurry of phone calls and emails, Tim was able to secure the original SV
judges, the venue, and the Host hotel for the weekend prior, April 11-13. Please
ensure that you change your plans accordingly.
National Breed Warden Tim Burker stated, "We apologize for the inconvenience, but due to the scheduling of the SV meeting,
we had no choice. The host hotel has moved all existing reservations to the new
date. While somewhat inconvenient (to change dates) we are early enough to avoid
major issues or conflicts."
The host hotel states that it is actually a better date for those making reservations
that want double bed rooms because of more availability.
If you have already made your reservations, please check with the host hotel to ensure
they have been changed correctly. If you are planning on staying someplace else, check with
that hotel. As always, get a confirmation number and keep your paperwork for the reservation.
Burke noted, "I spoke at length with Terry Macias (of the sponsoring
San Jose club) today and he has the whole region helping out with the show. They
are very excited and in Terry’s words 'we really are looking forward to putting on
a great event for our USA members.' Please support Terry and the region
for this event and encourage the USA members in your respective areas to participate."
Trial Secretary Tutorial

Your club has a trial coming and they need a trial secretary. What are you gonna
do?
Gail Kendall from the Phoenix Schutzhund Club has distilled her long experience
into a 30 minute tutorial on how to handle that task. From setting up the entry
forms, the judge's sheet and the final listing of the scores and titles, this outstanding
presentation covers it all!
Getting the paperwork completed correctly is a huge task in the USA office. Chasing
down corrections on the forms is a major effort. If all the forms came in correct
and complete, it would free a significant amount of resources to better serve the
USA membership.
The tutorial is about 30 minutes long. You will need to have the Flash plug-in available
on your computer to play it. Most browsers already have this installed.

The BAC has voted to approve the bid from the San Jose Schutzhund Club for the 2008
Sieger show. The show will be held on April 18 through 20, 2008. Watch the USA website

Is Your Event Using a Correctly Classified Helper?
This is a reminder from the USA Helper Committee regarding the proper use of Helpers
in all authorized USA Events. There has been some confusion regarding the level
of helpers to work events.
The guidelines are:
- All helpers working a USA Event must be current USA members and have a Helper Book with a classification noted in the book of Basic or higher.
- Entry level helpers may not work events. These are helpers
that are USA Members and have purchased a book, but not attended and passed a seminar/classification.
- Basic level helpers may only work club level events — not regional championships
or nationals.
- Club level helpers may work club level events and be considered for selection at regional level events.
- Regional level Helpers may work club and regional events and be considered for national events.
- National level helpers may work any event.
- Teaching helpers may teach as well as work any level of event that they are selected to work.
The current helper classifications are listed on the USA website. Click here to view the
helper classification list. However, the most recent classification noted in the helper's book will be the determining one when selecting a helper for trial work.
In the event that a club does not have a "classified" helper available to work an event
they should contact the Helper Program Director
to request a special circumstances waiver to allow the event to proceed.
It is the Trial Secretary and, secondly, it
is the judge's job to verify that the helper is properly "Classified" to work the
event. It is also the helper's responsibility to know what level event they are allowed
to work.
Failure to follow the program rules may lead to unsportsmanlike conduct
charges, revocation of the Helper's book or charges against the club.
The goal and mission of the helper program is to improve the quality , education and performance
of trial helper work at all levels of events. Our committee is here to help and
we will support helpers and clubs in any way to promote the proper progress of the
scheduled event.

GEC Committee Changes

Christine Gajda has stepped down. Christine was very helpful to all of us in the formative stages of the GEC. She has taken on a new position which does not lend itself - in terms of any free time - to be an active member of the GEC. All of us at the GEC and USA will miss her contributions to the various issues. We wish her the best in her new endeavors
Melinda Darby has joined the committee as the new committee secretary.
Marnie Rose has joined the GEC. She hails from Ohio and is very passionate about countering anti-dog and breed-specific legislation.

The USA General Board Meeting was held on Thursday. Some highlights …

- Approval of Artificial Insemination for USA Registry
- 2008 National Events
The HOT & NA events will be combined in 2009.
- Proposed bylaw amendments prohibiting convicted felons from holding office as members
of the EB, officers, regional officers and judges passed. Waiver (proposal 5) passed.
- Laurie Tollifson was recognized for her outstanding work on developing USA's
registry. Laurie contributed innumerable hours on this project, gratis, for USA.
- A quorum of 35 club delegates was seated.

The USA General Board meeting will be held on November 8th this year in Carrollton, Georgia. If your club plans to send a delegate to the meeting, a delegate form must be submitted to Sara Wallick, the USA Secretary, no later than 30 days prior to the meeting. A copy is also available on the USA website in PDF format which can be completed online and then printed. (Click here for the Delegate Form)
Please be sure to send the delegate form to the USA Secretary, not to the USA Office or the USA
Treasurer.
Two club officers must sign for the delegate/alternate(s) selected, and the delegate/alternate(s) may
not sign for themselves. In addition to prior submittal of the delegate form, please have the delegate/
alternate(s) carry a copy to the meeting. Clubs that are granted affiliated or full-member status after
October 9, 2007 may send the delegate form to the meeting with the delegate/alternate(s). Please feel
free to contact Sara if you have any questions regarding the voting process at the General Board
meeting. Sara's contact information is listed on the Delegate Letter form.
Each full-member club may seat one voting delegate at the General Board meeting and each affiliated
club may seat one non-voting delegate. A club may replace its delegate and/or alternate(s) as
necessary. Please notify me immediately of any replacements.
Important
You must send the delegate forms directly to Sara — not the USA office or the USA Treasurer. The forms must be submitted to the USA Secretary no later than 30 days prior to the November 8th meeting.

In order to be eligible to seat a delegate at the General Board meeting
- the USA dues of the club must be current,
- the USA dues of all members of the club must be current,
- the club may not be under any disciplinary action from USA,
- the club must maintain a minimum of five members (only two of
whom may be part of a family membership)
- the club must hold at least one sanctioned USA trial per year.
- a complete and current club membership list must be submitted to the USA Office for
verification along with the USA dues of the club, whether or not the club is planning to send a
delegate to the General Board meeting.
It will not be possible to seat delegates if these requirements
are not met.
If you wish to have confirmation of receipt of your delegate form, you may request email confirmation
or use USPS certified mail/return receipt requested.
It will be very important for delegates to be seated and ready for roll call promptly at the meeting
start time. The delegate cards will be handed out as roll is called.
Please send a delegate to the meeting if at all possible, as there will be important decisions made regarding our organization.
In addition, this year there will be elections for:
- Judges Committee members at large (2 positions)
- National Events Committee (4 positions)
- Nominating Committee (5 positions)
- Director at Large (1 position)

Registration Update

In June, USA VP Randall Hoadley and USA National Breed Warden Tim Burke traveled to the Schutzhund USA office to meet with staff and assist in resolving some of the issues that the membership has brought up as well as review the new registration system.
Current SV breed surveys
The SV would not process breed surveys that were written in English. The office has attempted numerous times to have the SV modify the contract to allow the SV to translate the documents, but the SV has not yet agreed to do so.
Schutzhund USA has hired a translator and forwarded all of the pending registrations to
the translator. The translator has given us a date of August 15th to have the backlog of
surveys completed. USA President Lyle Roetemeyer and USA National Breed Warden Tim Burke will be
meeting with the SV office at the German Sieger show to find a permanent solution for
translations. Until that resolution, the translator
hired by Schutzhund USA will complete the breed surveys.
Current Schutzhund USA registrations
All the pending registrations have been processed and the USA office will begin printing and mailing them in the next two weeks.
New Schutzhund USA registration system
Tim met with Becky Burns and Pam Niccum to review the new Schutzhund USA registration system. The new registration database was built through the volunteer efforts of USA member Laurie Tollifson, who donated countless hours of time to this effort. As you are aware, there have been many problems that delayed the registration project.
- One of the biggest issues that came up was that the database application was finished last December, but there was no data entered.
- The registration document has a multi-generational pedigree on the inside, similar to the SV registration document. It would have been necessary for the office staff to type each line in on the pedigree and that would have been very inefficient.
- One of the primary goals of the registration database is to develop a database of USA dogs that includes information on USA titles and event results. We sourced the database information and Laurie integrated that information into the registration application. The office has been using and entering information into the database during the last two months.
- The team at the office test printed a sample registration document for Tim. The group decided that a higher quality paper with pre-printed borders and blocked areas should be required because the membership deserves a quality document that properly reflects their dogs’ pedigree. Kathy Mocanin was able to source the paper and worked with the office on standardizing the process.
- The new paper will be delivered to the office next week and the office will begin issuing new Schutzhund USA pedigrees in the next two weeks.

Working Malinois Association).
Background
The AWMA is an AWDF member club. Currently their DOJ is also a USA
Judge and the only other AWMA Judge is also a USA Judge (myself).
The EB has in the past allowed our judges to accept licenses from
other AWDF member clubs as a way to support these organizations and
to build the credibility of our judges and our program. At all
times, our USA Judges are expected to hold their commitment as a
USA Judge first

AWDF Titles

be recognized exclusively for progression pertaining to those titles. These titles
will not be recognized for entry in the USA-GSD National Championship, for the USA
SchH3 Club, or for the USA Sports Medals Program. These titles will not be recognized
for German Shepherd Dogs as prerequisites for breeding, breed surveys, breed shows,
or registration with USA.

The action of falsely claiming “H.O.T.” status goes to the very
heart of sportsmanship in this community. The USA membership has
been very clear in its adoption of the H.O.T. criteria, and the
consequences of falsely claiming H.O.T. status. Those consequences
adopted by the membership make it clear that false H.O.T. claims
are not to be tolerated by the membership, the sport, or the
organization. Based upon the membership’s strong directive, it
is the recommendation of the BOI that Lynne Lewis be censured for
unsportsmanlike conduct and violation of USA’s H.O.T. rules.

BOI Case: USA v. Rick Burgos

and recommendation of the Board of Inquiry in the case of USA v. Rick Burgos
Rick Burgos engaged in conduct that constituted unsportsmanlike conduct. Mr. Burgos
violated established USA rules with respect to the public display of an electric
training device during a sanctioned USA event; and, by violating these rules, Mr.
Burgos also engaged in conduct that was highly prejudicial to the interests of USA.
Based upon the foregoing, the BOI recommends the following:
- That Rick Burgos be censured for unsportsmanlike conduct and violation of USA rules
- That the scoresheet and the published results of the event be corrected to reflect
that Rick Burgos received no points in the event, per USA trial rules.
- That the Executive Board review the USA Rulebook and consider making a clarification
to require the USA Director of Judges, the USA President, or USA Secretary to file
BOI charges with respect to instances of disqualification for "unsportsmanlike conduct"
within two weeks of the completion of the event in which a competitor is disqualified.
The USA Rulebook currently states that the BOI will investigate in such instances.
The BOI, however, cannot of its own accord investigate such matters; charges must
be filed for the BOI to investigate anything.

in Florida, as a USA Performance Judge. He has fulfilled all of the requirements
as specified in the USA Performance Judges Program, Section K, Acceptance of Foreign
Judges in the USA Performance Judges Program.
Background
Dieter has sent reports of at least his last four trials to me
unbidden, and has sat with me at trial and also at the 2007 USA-GSD National Championship
where I was able to observe his evaluation procedure and philosophy on judging and
the sport of Schutzhund. His résumé of experience is attached and he has the recommendation
and approval of the USA Judges Committee.

Budget Approval for Dog World Advertisement

of four full-page advertisements in Dog World magazine beginning with the March
2008 issue. This special price of $1,000 per issue is discounted from the normal
price of $1,800. USA and the WUSV 2008 World Championship will be featured in the
ads. There is $3,000 in the budget for advertising, and the additional $1,000 will
be paid from cash reserves.

BOI Case: June Sexton v. Laurie Stupak

Motion by Sara Wallick, seconded by Al Govednik, to accept the determination and
recommendation of the Board of Inquiry in the case of June Sexton v. Laurie Stupak.
This case is about Stupak's actions as RMGP Regional Secretary
Sexton states Stupak's actions caused the election to be invalid. Stupak's behavior
is rendered moot by the dissolution/elimination/absorption of the region (RMGP),
particularly as that election and its irregularities are among the factors that
led to the Executive Board decision. Stupak's various emails to the region were
confusing and/or ambiguous regarding the "rules of conduct" for the election, setting
the stage for a mess. Also, Stupak's inclusion and acceptance of the faxed ballots
was in violation of the USA Bylaws. Stupak's actions were questionable regarding
the handling of ballots in general, and Twin Peak's ballot in particular.
Charges
- Stupak caused the RMGP election to be invalid by ignoring USA Bylaw. – Charge is
sustained.
- The evidence shows that Stupak received ballots via USA mail or fax.
- Stupak also admits and apologizes for her mistake by allowing faxed ballots.
- The RMGP Region has been dissolved; therefore the charges are invalid.

Stupak did not conduct elections by secret ballot causing further problems. – Charge
is not sustained.
- There is no evidence to prove that the balloting was not conducted in secret, although
secret implies that no one knows how anyone voted.
- The RMGP balloting may have been "confidential," because only Stupak knew who voted,
and how. There is no evidence Stupak told anyone else what she knew about the votes.
- The RMGP Regional Bylaws did not provide guidelines for balloting.
- USA Bylaws, Article X, Section 6 establishes rules for elections and deadlines for
nominations. Delegate letters are not defined.
- Regional Director John Oliver decided that only official club contacts (listed in
the magazine) would be considered as official club representative for voting
CONCLUSION AND RECOMMENDATIONS
This Board believes that Stupak's actions were detrimental, but rendered moot by
the dissolution of the region. This Board does not recommend any disciplinary action
against Stupak.
The Board of Inquiry believes that every club in a region should have the right
and opportunity to vote. The USA Bylaws require clubs to be notified 30 days prior
to any regional meeting or election. This Board recommends that the region consider
a 60–90 day notice instead, giving the regional clubs ample time to send a delegate
with voting privileges to the meeting or to nominate a candidate(s) for office.
This Board recommends that all regional bylaws/guidelines should specify a quorum;
i.e., USA Bylaws state a quorum (percentage of clubs) must be met, or regions must
reference USA Bylaws when confirming a regional quorum. The USA Bylaws already provide
for mail ballots. It is the recommendation of this Board that the Executive Board
consider a bylaw change by adding to the USA Bylaws the procedure for mail ballot
elections as shown below.
Mail Ballot Procedures for Elections
- Mail ballot counting for elections need to be secret
- The announcement for a mail ballot election is to be made via the Regional Director
by USPS mail, email, and/or fax not less than thirty (30) days prior to the closing
date of the election.
- The announcement must state: The Region will conduct the 200– officer elections
per USA Bylaws via USPS mail. Offices to be elected are: Regional Director, Assistant
Regional Director, Regional Secretary, Regional Breed Warden, and Regional Training
Director.
- All ballots must be returned to the Regional Secretary via USPS mail only with certified
return receipt/confirmation of delivery and postmarked no more than thirty (30)
days after announcement. Faxed or emailed ballots will not be allowed or recognized.
- Only official club delegates from full-member clubs will be permitted to vote in
the election.
- Club contacts listed on the USA website will be considered the official club delegate
unless the Regional Director is notified otherwise.
- Clubs may change contacts through the Regional Director via USPS mail, fax, or email.
- Nominations and seconds to the nominations may only be made by the club delegates,
and must be received by the Regional Secretary, via USPS mail, fax, or email no
later than two weeks after the announcement is made
- All nominations must have a second, and write-in balloting is permitted.
- A ballot listing the office to be elected will be placed in a plain white inner
envelope. This plain white envelope is placed inside another envelope addressed
to the club delegate. Another envelope will be addressed and stamped (SASE) to the
Regional Secretary, and placed with the plain white envelope inside the envelope
addressed to the club delegate. The ballots will be mailed to each club delegate
in this form.
- The ballot must be marked and returned to the Regional Secretary only
- The delegate will place the marked ballot inside the blank white envelope, seal
it, and place this envelope inside the SASE which is addressed to the Regional Secretary.
- The return address of the delegate must be added to the outside envelope (SASE)
by the Regional Secretary so that the delegate's name may be checked against the
list of delegates eligible to vote.
- Ballots for elections need to be sent only by USPS mail, not by fax or by email,
and returned via confirmation of delivery and/or certified/return receipt.
- Ballot committee must be impartial and a committee of three.
- When the committee meets to count votes, the members will open the outer envelope
and check the delegate’s name. This outer envelope will be destroyed. The blank
white envelopes will be placed in a pile. Only when all of the SASE have been emptied
and discarded will the plain white envelopes be counted
- The counted ballots must be retained by the Regional Secretary

USA Working Dog Championships

National Championship, and Obedience National Championship into an event titled
the USA Working Dog Championships.

same window in May that the North American Championship and FH Championship now
hold.

This will provide one large event instead of two poorly attended smaller events,
will make USA and the sport more affordable and attractive to new members, and will
require finding one less championship host club.

top ten dog/handler teams overall and the top ten dog/handler teams for the H.O.T.
USA will sponsor the H.O.T. trophies. National event bid forms for the USA Working

judges program that mirrors our own, the titles would be accepted in the same fashion
that we accept titles earned under DVG judges, and the titles would only be accepted
as progression pertaining to performance titles (i.e., SchH1 to SchH 2, etc.).

BOI Case: June Sexton vs. John Oliver

John Oliver has refused to comply with
the disciplinary requirements arising from a BOI decision that was also adopted
by the Executive Board. John Oliver's USA membership lapsed on June 1, 2007 while
he remained in a disciplinary status (i.e., a member not in good standing). Consequently,
due to the lapse of his USA membership, Mr. Oliver is no longer subject to USA's
disciplinary procedures.
Therefore, the USA Board of Inquiry unanimously recommends
that John Oliver be ineligible to rejoin USA or to renew his membership in USA until
he meets the previous BOI requirements.

Appeal of Southwestern Regional Director Decision

The So Cal Working Dog Association has appealed the decision of Southwestern Regional
Director Michelle Kutelis to cancel the event authorization for a trial that So
Cal Working Dog Association was to host on September 22, 2007. The event authorization
was canceled was due to failure of the club to provide written event notification
to the other clubs in the region at least three weeks in advance of the event, as
notification was provided just 18 days prior to the event instead. (Appeal attached.)
Shall the Executive Board overrule the decision of the regional director and allow
the trial scheduled for September 22, 2007 to proceed?

Training Restrictions at USA Events

Motion by Mark Przybylski, seconded by Howie Rodriguez, to adopt the following USA policy:
As of November 1, 2007, at USA-sponsored national, regional and club events (performance trials, breed shows, breed surveys, herding trials) there shall be no aggressive training devices (i.e., prong collars, electric collars, etc.) carried by the handler or worn by the dog at any time after the official start of the event within 100 yards of the boundaries of the event stadium/trial field and/or tracking fields as designated by the hosting club. The only collar or tracking harness allowed will be as stipulated in the USA Rulebook or by USA.
Failure to observe this restriction will result in punitive action: immediate disqualification for unsportsmanlike conduct from the event and possible expulsion from the event site, if deemed necessary. This enforcement shall be the sole responsibility of the judge(s) at the event.
The official start of a national or regional event is defined as the first official day of any phase of competition and ends with the event’s closing ceremonies.
The same 100-yard rule will be in effect at club events from the beginning to the end of competition each day.
During the training/practice phase at all USA-sponsored national, regional, and club events (performance trials, breed shows, breed surveys, herding trials), aggressive training devices will be allowed at the event stadium/trial field and/or tracking fields before the official start of the event, but may not be used there or at any other location to a degree that they could be construed as abusive in any way. This also covers any type of abusive training or behavior inflicted with any type of device or actions, which could be demonstrated by demeanor that shows the dog is under undue stress other than that which comes from normal trialing.
The training aspect of events such as training seminars of any kind will be the responsibility of the hosting club, and that responsibility must not be taken lightly.

Regional Boundary Change

Motion by Bill Plumb, seconded by Al Govednik, to realign the Mid-Central, Northwestern, and South Central regions as follows: The Rocky Mountain/Great Plains Region will be eliminated and the area will be reassigned. Colorado will become part of the Mid-Central Region, Utah will become part of the Northwestern Region, and New Mexico and West Texas will become part of the South Central Region.
The RMGP Regional Championship will be eliminated. Any competitor in the former RMGP Region who is otherwise qualified to enter the 2007 USA-GSD National Championship with a 270-point qualifying score attained at any USA regular club trial will be given a waiver for regional participation.

USA Policy on Training Devices/Methods

The United Schutzhund Clubs of America promotes safe and humane training methods for dogs. All types of "training devices" or "methods" are accepted by USA, when used in a safe and humane manner, and may be used in training and practice up until the official start of a USA event. The official start of a USA national event is defined as the “draw,” and the official start of a USA regional or club event is defined as the first day of competition.
In some instances, with prior notification in the event flier, practice time for the event may not be provided and/or training devices used while on the event site may be restricted to the type of chain collar allowed in a trial. If a lead is used in that case, it may only be attached to the dead ring of the collar.
Any USA member who demonstrates unsafe and/or inhumane treatment of a dog during training or practice may be disciplined by USA if another USA member files a complaint of "unsportsmanlike conduct" with the Board of Inquiry and the complaint is found to be valid.

Rocky Mountain/Great Plains Regional Election

Motion by Al Govednik, seconded by Sara Wallick, that the Executive Board invalidate the Rocky Mountain/Great Plains regional election and re-conduct the election consistent with the process described in Sturgis, with the election to be conducted by an election committee named by the USA President.
Upon review of the evidence presented in the appeal filed by June Sexton regarding the regional elections in the RMGP Region, it became clear that the irregularities and inequities of the election process went beyond the matter of Twin Peaks Schutzhund Club’s ballot. It also appears from review of the documentation that re-conducting a fair election by the region is questionable.
- Procedures required for carrying out a fair election were not observed, as the procedures provided in Sturgis for voting by mail to ensure a secret ballot were not used.
- Procedures or actions during the election were unauthorized or illegal, as there is no provision in the USA Bylaws for the use of faxed regional election ballots.
- There was gross negligence in conducting the election, due to the changing criteria for how ballots were to be submitted, the changing submittal date of the ballots, the changing voting delegate criteria, the failure to alert the Twin Peaks delegate their ballot submitted on May 26 was insufficient, and the failure to answer the direct question posed by the Twin Peaks delegate about the validity of their ballot on the last day of the election.
- The election requirements in the bylaws were not correctly interpreted or followed, as there is no provision in the USA Bylaws for the use of faxed regional election ballots.

Appeal of Rocky Mountain/Great Plains Regional Director Decision

June Sexton of the Rocky Mountain Schutzhund Club has appealed the decision of Rocky Mountain/Great Plains Regional Director John Oliver that disallowed the vote of the Twin Peaks Schutzhund Club in the election for Rocky Mountain/Great Plains Regional Director. (Appeal attached to original ballot)

Sharyn Baker of the Colorado Alpine Schutzhund Club has appealed the decision of Rocky Mountain/Great Plains Regional Director John Oliver to cancel the club’s June 2007 trial because the event flyer was inadvertently sent to the other clubs in the region four days late, even though the event had been publicized on the USA website and in Schutzhund USA.

BOI Case: June Sexton vs. John Oliver
E-Ballot #14-07
Motion by Al Govednik, seconded by Sara Wallick, to accept the determination and recommendation of the Board of Inquiry in the case of June Sexton vs. John Oliver, with the modification that the apology be in writing and be sent to all regional clubs.
It is the determination of the BOI that:
- Sexton’s allegation regarding Oliver’s conduct of a regional meeting without a quorum is not sustained.
- Sexton’s allegation that Oliver falsely represents himself as the regional director is not sustained.
- Sexton’s allegation that Oliver’s actions with respect to club contacts is a matter prejudicial and/or detrimental to the interests of USA is sustained.
- Sexton’s allegation regarding Oliver’s club co-hosting, rather than hosting a regional event alone, without a regional vote, is a not an issue detrimental or prejudicial to the interest of USA and is not sustained.
It is the unanimous recommendation of the BOI members that:
- Oliver should receive a censure from the Executive Board.
- Oliver should make an apology to his region, with assurances that he will make a greater effort to follow rules and procedures, and apply them in an even-handed and consistent manner.
- Oliver should be ineligible to hold office as regional director for one two-year term, i.e., be ineligible to run for or hold office as RMGP regional director in the regional elections that should be held in 2007.
Vote: Yes–17, No–2, NFD–1, ABS–1. Motion carried 5/23/07.
