Motion by Al Govednik, seconded by Sara Wallick, to accept the determination and recommendation of the Board of Inquiry in the case of Eric Eisenberg v. Gary Hanrahan and to adopt the following resolution:
Whereas, The Executive Board, having carefully considered all of the issues involved in the complaint filed by Eric Eisenberg against Gary Hanrahan;
Whereas, Having referred to the Board of Inquiry the reconsideration of their prior recommendation in light of the new evidence from the trial transcript in the matter of the State of Alabama v. Gary Hanrahan;
Whereas, The Board of Inquiry having carefully considered the transcript and having decided that such evidence did not change their determination that Hanrahan engaged in conduct that was disruptive of a USAsanctioned trial;
Whereas, The Board of Inquiry having issued a subsequent ruling on October 23, 2008 adhering to their original determination that Gary Hanrahan’s actions on December 15, 2007 continued to merit a reprimand from USA;
Whereas, The Executive Board takes notice of the findings of the Board of Inquiry that Gary Hanrahan engaged in unsportsmanlike behavior when his actions on December 15, 2007 disrupted a USA-sanctioned trial and such conduct was contrary to the best interests of USA;
Resolved, That based upon all of above, the Executive Board accepts the Board of Inquiry’s recommendation and hereby publicly censures Gary Hanrahan for unsportsmanlike conduct for his actions on December 15, 2007. While Hanrahan may have believed that he was properly in defense of another’s property, taking actions that disrupted a USA-sanctioned trial was not in the best interests of USA. By publicly censuring Hanrahan, USA, the Executive Board, and the Board of Inquiry, individually and collectively, make no factual finding as to Eric Eisenberg’s or CASC’s right to utilize the field in question, nor do any of the above make any factual finding that Gary Hanrahan was or was not acting at the direction of the owner of the property or believed he was doing so.
USA’s only factual finding here is that Hanrahan’s conduct with regard to driving over the tracks at a USAsanctioned trial was not in the best interests of USA. Hanrahan is publicly admonished that his behavior on December 15, 2007 fell below that reasonably expected of USA members and he is directed to make certain that all of his conduct at USA-sanctioned events in the future is proper and is in accord with sportsmanlike behavior and conduct expected of all USA members.
Further, the Executive Board finds that much if not all the conduct of Eric Eisenberg and Gary Hanrahan on December 15, 2007 was in furtherance of their continuing interpersonal conflict. Neither party to this dispute has distinguished themselves as exhibiting the behavior, cooperation, and good will expected of all USA members. The Executive Board advises both Gary Hanrahan and Eric Eisenberg that any future conduct, communication, actions, or disputes by either party in furtherance of their continuing interpersonal conflict that impacts any USA event at any time in the future will lead to more severe disciplinary action against one or both parties, including expulsion from USA. While any future disciplinary action will be based upon the particular facts and circumstances of each case, it is the sense of the current Executive Board that any suspension for either or both parties will be for a minimum of six (6) months. All are advised to conduct themselves accordingly.

(BOI Case: Der Michigan Schutzhund Verein v. Timothy Wild)

Motion by Sara Wallick, seconded by Al Govednik, to accept the determination and recommendation of the Board of Inquiry in the case of Der Michigan Schutzhund Verein v. Timothy Wild.
CHARGE Timothy Wild was charged with conduct prejudicial to the interests of USA as a result of kicking another competitor’s dog in the head during the course of the trial, in plain view of trial observers. The charge was sustained.
CONCLUSION AND RECOMMENDATION The BOI has conducted a thorough investigation and received testimony from numerous spectators, event personnel, a regional officer, trial participants, and SV and USA judges. It was made clear that this matter involved solely Mr. Wild’s actions. There is no dispute that, during the trial at Der Michigan, Mr. Wild kicked another competitor’s dog (belonging to Chris Wild, the defendant’s wife) in the head while the competitor was exiting the trail field.
The investigation revealed that Mr. Wild’s behavior was addressed by the training director and the club secretary of Der Michigan. Mr. Wild was advised that his behavior was unacceptable, and was told that Der Michigan would not prefer charges, but would hold this incident in abeyance, with the understanding that there should be no reoccurrence of uncontrolled outrage. Thereafter, Mr. Wild was disqualified at a USAsanctioned event at Capitol Area Schutzhund Club for uncontrolled anger. This incident precipitated the filing by Der Michigan of charges of unsportsmanlike conduct against Mr. Wild for the trial at Der Michigan held on July 29, 2007.
In conclusion, this board recognizes that Timothy Wild did engage in conduct that constituted unsportsmanlike conduct, which is highly prejudicial to the interests of USA. The USA Bylaws specifically state that one of the objectives of the organization is “…to promote humane training methods for the working dog…” Based upon the foregoing, the BOI recommends the following:
1. That Timothy Wild be censured for unsportsmanlike conduct.
2. That Timothy Wild be advised that, should any further charges with respect to instances of unsportsmanlike conduct be heard, he will be subject to more severe discipline, including possible expulsion from USA.

(GSD National Championship Waiver for Manuel Valdes)

Motion by Tim Burke to grant a waiver to allow Manuel Valdes to enter the 2008 GSD National Championship with a qualifying score obtained on his imported SchH3 dog on August 2 rather than by August 1 as required. Manuel imported his dog in 2007; but, due to several job transfers, had forgotten to register it with USA and have the scorebook certified until July 17, 2008. He was not aware of the following rule on imported SchH3 dogs:
2001 GBM–Taunton (National Championship Qualification Process) – Motion to modify the existing National Championship qualification rule to read: Any SchH3 dog imported into the U.S. whose scorebook is registered with the USA Administrator of Records Office after January 1 of any calendar year must attain a qualifying score by August 1 of the same calendar year for entrance into that year’s Nationals. This rule does not pertain to imported SchH1 or SchH2 dogs or their equivalent.

Falconhurst Police Canine Corps has appealed the decision of Mid-Eastern Regional Director Mark Scarberry to cancel the event authorization for a Helper Seminar/Evaluation that Falconhurst hosted July 12–13, 2008 with USA Teaching Helper A. J. Slaughter. The event authorization was canceled due to the failure of the club to provide written event notification to the other clubs in the region at least three weeks in advance of the event, as notification was provided just one day prior to the event instead. The event authorization was issued on June 5 2008, and the event has been posted on both the USA and Mid-Eastern Region websites since that time. Unfortunately, however, the trial secretary overlooked the three-week event notification rule.
Shall the Executive Board overrule the decision of the regional director and waive the event notification requirement for the Helper Seminar/Evaluation held July 12–13, 2008?

Motion by Nathaniel Roque that Mark Przybylski be permitted to accept a working dog judge license in the AWMA (American Working Malinois Association).
Background: The AWMA is an AWDF member club. Currently their DOJ is also a USA Judge and the only other AWMA Judge is also a USA Judge (myself). The EB has in the past allowed our judges to accept licenses from other AWDF member clubs as a way to support these organizations and to build the credibility of our judges and our program. At all times our USA Judges are expected to hold their commitment as a USA Judge first.

1. Regional Director Lewis verbally attacked Snohomish Schutzhund Club member Vicki Stephens at the July 28, 2007 PNW regional meeting. – Not sustained 2. 3. Regional Director Lewis allowed the 2007 PNW Regional Championship to be scheduled on the same weekend as the USA Sieger Show. – Not sustained 4. Regional Director Lewis was involved in helper selection for the 2007 PNW Regional Championship and knew that Willie Pope was not a classified helper eligible to perform helperwork for the event. – Not sustained This committee recommends that SV Judge Franz Dörr should not be permitted to judge in any USAsanctioned trial for one (1) year from the date of this determination, due to his blatant disregard for established USA policies.
5. Regional Director Lewis does not support conformation shows or give respect to show dog owners/handlers. – Not sustained 6. Regional Director Lewis overruled the Snohomish Schutzhund Club’s decision to not have a delegate at the September 15, 2007 PNW regional meeting. – Sustained The BOI concludes it is prejudicial to the interests of USA to have a regional director overruling a club’s decision or choice as to whether it will send a representative to a regional meeting, or to vote.
7. Lewis falsely claimed H.O.T. status of the dog, City v. Siegerhof while competing in the 2007 PNW Regional Championship. – Sustained The action of falsely claiming “H.O.T.” status goes to the very heart of sportsmanship in this community. The USA membership has been very clear in its adoption of the H.O.T. criteria, and the consequences of falsely claiming H.O.T. status. Those consequences adopted by the membership make it clear that false H.O.T. claims are not to be tolerated by the membership, the sport, or the organization.
Based upon the membership’s strong directive, it is the recommendation of the BOI that Lynne Lewis be censured for unsportsmanlike conduct and violation of USA’s H.O.T. rules.

(BOI Case: USA v. Rick Burgos)

Motion by Sara Wallick to accept the following determination and recommendation of the Board of Inquiry in the case of USA v. Rick Burgos.
Rick Burgos engaged in conduct that constituted unsportsmanlike conduct. Mr. Burgos violated established USA rules with respect to the public display of an electric training device during a sanctioned USA event; and, by violating these rules, Mr. Burgos also engaged in conduct that was highly prejudicial to the interests of USA. Based upon the foregoing, the BOI recommends the following:
1. That Rick Burgos be censured for unsportsmanlike conduct and violation of USA rules.
2. That the scoresheet and the published results of the event be corrected to reflect that Rick Burgos received no points in the event, per USA trial rules.
3. That the Executive Board review the USA Rulebook and consider making a clarification to require the USA Director of Judges, the USA President, or USA Secretary to file BOI charges with respect to instances of disqualification for “unsportsmanlike conduct” within two weeks of the completion of the event in which a competitor is disqualified. The USA Rulebook currently states that the BOI will investigate in such instances. The BOI, however, cannot of its own accord investigate such matters; charges must be filed for the BOI to investigate anything.
